House Rules

THE TENANCY CREATED BY THIS AGREEMENT IS GOVERNED BY THE RESIDENTIAL TENANCIES ACT AND IF THERE IS A CONFLICT BETWEEN THE AGREEMENT AND THE ACT, THE ACT PREVAILS.

Alberta Residential Lease Agreement

Between; Gordon James (also referred to as Landlord, or my)

And

“Guest” (also referred to as Tenant, or you, or your)

FIXED TERM LEASE AGREEMENT (this “Agreement”) – Gordon James does demise and lease unto the Tenant the property in its entirety as described in the listing (the “Property”) for the exclusive possession of the Tenant for a fixed term outlined in the agreed upon and accepted Booking Confirmation. The terms and conditions contained in the listing for the Property and the Booking Confirmation are incorporated into, and form an essential part of, this Agreement. In the event there is any conflict between this Agreement and the listing for the Property or the Booking Confirmation, the terms of this Agreement will prevail.

OFFLINE SECURITY DEPOSIT REQUIRED
$500 or not to exceed one month’s rent.

CONDITIONS AND TERMS OF TENANCY;

All public health orders in place at the time of tenancy must be followed, including any applicable masking or face covering requirements. Tenants are expected to be clean, orderly and respectful of other building residents so the residents can have quiet enjoyment of their home. This includes following the strict Quiet Hours that are between 10pm and 8am. Noise complaints are of concern and may result in not being able to list the Property for future tenants such as yourself to enjoy so PLEASE be mindful.

MOVE-OUT INSTRUCTIONS
The landlord does not provide cleaning services for tenants. The Tenant is required to wash their dishes and one load of their used laundry started (WASH ONLY) before Move-Out. This includes towels, fitted bed sheet, unfitted bed sheet and pillowcases.

DAMAGES

Any damage made to the Property between check-in and check-out (“Damage”) will be noted and documented. The Tenant will be contacted regarding any repair, or replacement required as a result of the Damage and will be responsible for all costs associated with the repair or replacement. No shoes may be worn past any entries of the Property. A lost key fob will result in $150 replacement fee.

PRIORITY CHECKIN/CHECKOUT (SUBJECT TO A FEE AND 24 HOURS NOTICE)

Early/Late Check-Ins and Late Check-Outs can be requested for a fee of $50/hr. If a late check-out is not agreed to by the Host, the Tenant will in no circumstances over-hold the tenancy and will vacate the Property not later than the date and time specified on the Booking Confirmation.

AUDIO/VIDEO/STILL CAMERA SECURITY CAMERAS AND RECORDING DEVICES

Shielding, covering or intentionally interfering with these Audio/Video/Still Image recording devices will result in immediate removal of the Tenant from the Property due to safety and security concerns. Please consider all of the following devices actively record 24 hours, 7 days a week for the safety and security of the building’s community members. Images of these devices can be found in the listing’s photos.

Check-In / Intercom device is located at the front lobby and is used for your initial check-in process, to verify your identity, and to ensure any public health orders are being followed.
Ring Doorbell Pros are located to the left of the unit door for verification of all tenants and visitors identities and tenant and visitor counts.

Minut decibel monitors are located in the Property. These sensors monitor the noise level in the Property, but do not record audio. This means the devices detect issues in real time, keeping the Property safe and the relationship with my neighbours strong, all while protecting your privacy.

UNRESERVED ADDITIONAL TENANTS
A fee of $100 per person applies to ANY unreserved tenant or visitor that enters the building. The Host requires notification of, and must provide consent for, any additional tenants or visitors that are unreserved and visiting the Property. Any commercial / business use of the Property is strictly prohibited. Prior consent is required before any photography and / or videography taken within the Property is made available on any public or commercial forums or social media accounts.
A location fee will apply, please inquire first before booking!

CRITICAL HOUSE RULES:
NO SMOKING / VAPING OR DRUG USE. ($500 Professional Cleaning Fee (Website hidden by Airbnb) NO PARTIES / EVENTS / GATHERINGS.
ALL PUBLIC HEALTH ORDERS MUST BE FOLLOWED.
NO ADDITIONAL UNRESERVED TENANTS / VISITORS. NO EXCESSIVE OR UNDUE NOISE.
(Quiet hours 10pm-8am)
NO PETS ALLOWED IN BUILDING / PROPERTY. ($1,000 FINE)

LIABILITY OF HOST
The Host will in no way be liable or responsible for any damage, however caused, to any property belonging to or owned by the Tenant, by other tenants, or by visitors to the Property while such property is located upon the Property. The Host will in no way be liable or responsible for any personal injury or death that may be suffered or sustained by the Tenant, other tenants or visitors.

ASSIGNMENT AND SUBLETTING
The Tenant shall not assign this Agreement, the fixed term hereby granted, or any part thereof, nor leave any other tenant or visitors in charge of the Property.

DEFINITIONS;
“Tenant” is the primary residential lease agreement applicant.
“Host” is the owner of the residential premise and can be used interchangeably as Landlord. “Review” can be used interchangeably as Tenant Reference.
